What happens from October 1, 2023, if I have a seizure ordered by ANAF?
If until now, banks proceeded to transfer to ANAF the seized amounts within the legal term of 3 working days from the establishment of the seizure, starting with 1 october2023, banks must communicate to ANAF the amounts that can be paid for garnishments, as follows:
➤ until 17:00 on the next banking day after the day on which the address of the establishment of the attachment was communicated;
➤ until 5:00 PM of the next banking day after the day on which amounts were credited to the clients' accounts.
The change is at the level of all banks in Romania, following the Order of the Ministry of Finance no. 878/2022 and applies to all customers with garnishments instituted by ANAF after 01.01.2021.
Depending on the amounts communicated by each bank, ANAF:
➤ It will be decided from which bank accounts the garnishment will be paid;
➤ I will send a message to the banks (called payment order) for the transfer of the amounts.
For this reason, banks no longer transfer the amounts directly to ANAF after the establishment of a garnishment, but must wait for them to be ordered by ANAF.
Until its receipt, the bank will keep the sums that are to be paid in a special account named Certificate Balance Account for ANAF Garnishment. The account can be viewed in the account statement and in the Internet Banking applications.
The amounts in this account can no longer be released at the customer's request, and the bank cannot reduce the amount after the daily statement of amounts is transmitted to ANAF.
